Terms of use
Version 2.0 — 21 August 2026
Article 1 — Definitions
- Application: the Yin Shi service, accessible at yinshi.app/web and via the Android application distributed on the Google Play Store.
- Publisher: Ludovic Dumay, sole trader (SIRET 47966970700065), publisher of the Application.
- User: any natural person who accesses the Application, whether anonymous or registered.
- Account: identifier created with an email address and a password via the Supabase authentication service.
- Free trial: a 30-day period enabling access to Premium features without payment.
- Premium: full access to detailed food profiles and personalised recommendations, obtained through a paid subscription.
- Restricted access: limited access available after the free trial without an active subscription.
Article 2 — Purpose and acceptance
These Terms of Use govern the use of the Yin Shi Application. Use of the Application implies full and unreserved acceptance of these Terms of Use. In the event of disagreement, the User should cease all use of the service.
The terms relating to the paid subscription are defined in the Terms of Sale.
Article 3 — Eligibility
The Application is intended for natural persons aged 18 or over. By creating an account, the User declares that they have the necessary legal capacity. A minor User may not create an account, even with the authorisation of a parent or legal guardian.
Article 4 — Access to the service
4.1 Access levels
The Application offers three levels of access:
- Anonymous access: limited browsing on the home page and the food list (restricted preview, without detailed profiles).
- Free trial: 30 days of Premium access without payment, available after creating an account. No bank card is required to start the trial.
- Premium access: full access, active for the duration of the paid subscription taken out via the Web (Stripe) or the Google Play Store.
Upon expiry of the free trial without a subscription, the account reverts to restricted access. The User retains their account and preferences, but can no longer access Premium features.
4.2 Account creation
Creating an account requires an email address and a password. The User immediately accesses the Application and benefits from the 30-day free trial. A confirmation email is sent by the Supabase authentication service. The User is invited to confirm their email address to secure their account, although this confirmation does not block access to the Application.
4.3 Availability
The Publisher endeavours to ensure continuous availability of the Application, except during maintenance operations, updates, or technical incidents. Access to the service may be interrupted without notice. The Publisher does not guarantee the total absence of errors or malfunctions.
Article 5 — Exclusion of medical liability
The Yin Shi Application is a tool for discovering and learning about traditional Chinese dietetics (TCM). The content published (food profiles, TCM properties, recommendations, recipes) is provided for informational and educational purposes.
It does not constitute medical advice, a diagnosis, a prescription, or a regulated dietetics-nutrition procedure. The User acknowledges that the Application does not replace consultation with a qualified health professional (doctor, registered dietitian-nutritionist — title protected under article L4371-1 of the French Public Health Code).
The Publisher accepts no liability for the application of the principles described in the profiles without professional guidance. This applies particularly in the case of a medical condition, pregnancy, breastfeeding, ongoing medical treatment, or food allergy.
Article 6 — User obligations
The User agrees to:
- Provide accurate information when creating an account.
- Keep their login credentials confidential and not share them.
- Use the Application for personal, non-commercial purposes.
- Not attempt to access other users' data or the Publisher's systems.
- Not extract, scrape, decompile, disassemble, or reverse-engineer the Application or its content.
- Not reproduce, redistribute, or commercialise the content without written authorisation from the Publisher.
- Comply with applicable laws and the rights of third parties.
The User is responsible for all activity carried out from their account.
Article 7 — Intellectual property
All content within the Application (food profiles, texts, illustrations, design, source code, visual identity, logos) is the exclusive property of the Publisher, unless explicitly stated otherwise.
Any unauthorised reproduction, representation, modification, or exploitation, in whole or in part, is prohibited and constitutes infringement sanctioned by the French Intellectual Property Code.
Article 8 — Suspension and termination
The Publisher reserves the right to suspend or terminate a User's access in the event of a breach of these Terms of Use. This applies particularly in cases of fraud, misuse, unauthorised extraction of content, or violation of third-party rights.
The User may delete their account at any time from the Application settings or by request to contact@yinshi.app. Deletion results in the erasure of associated data within the timeframes set out in the Privacy Policy.
Article 9 — Personal data and cookies
The processing of personal data is described in the Privacy Policy. The use of cookies and trackers is described in the Cookie Policy.
Article 10 — Amendments to the Terms of Use
The Publisher reserves the right to amend these Terms of Use at any time. Registered Users are notified by email of significant changes at least 30 days before they take effect. The applicable version is the one published online on the date of use of the service.
If the User does not accept the amendments, they may terminate their account in accordance with Article 8. Continued use beyond the notification period constitutes acceptance of the new Terms of Use.
Article 11 — Applicable law and jurisdiction
These Terms of Use are governed by French law. In the event of a dispute, an amicable settlement will be sought first. Failing that, the French courts shall have jurisdiction. For consumers, the mandatory provisions of the French Consumer Code apply, including consumer mediation provided for in article L612-1 (see the Terms of Sale).
