Article 1 — Identification of the Seller

The publisher operates under a VAT exemption scheme; the prices indicated in Article 4 are therefore expressed inclusive of all taxes (TTC) and VAT is not charged separately.
Article 2 — Purpose and acceptance
These Terms of Sale govern the subscription, payment, and management of Premium subscriptions to the Yin Shi Application. Placing an order constitutes full and unreserved acceptance of these Terms of Sale.
Use of the Application is also subject to the Terms of Use.
Article 3 — Description of the service and medical exclusion
3.1 Premium service
The Premium subscription provides access to all detailed food profiles, personalised recommendations, and advanced features of the Application, for the duration of the subscription.
3.2 Medical exclusion
The service is provided for informational and educational purposes. It does not constitute medical advice, a diagnosis, a prescription, or a regulated dietetics-nutrition procedure (article L4371-1 of the French Public Health Code). The User is encouraged to consult a qualified health professional for any health concern.
Article 4 — Pricing, free trial, and payment
4.1 Pricing
Monthly subscription: €6.49 incl. VAT / month. Annual subscription: €69.00 incl. VAT / year (approximately 11% saving).
Prices are indicated in euros, inclusive of all taxes. The publisher operates under a VAT exemption scheme; no VAT amount is therefore charged separately. Prices may be changed at any time; changes do not apply to active subscriptions.
4.2 Free trial
A 30-day free trial is offered to all new registered Users. No bank card is required to start the trial. The trial does not automatically convert into a paid subscription. The User must subscribe explicitly at the end of the trial to continue benefiting from Premium.
4.3 Payment
On the Web (yinshi.app): payment is secured by Stripe. Accepted methods: bank cards (Visa, Mastercard, American Express), Apple Pay, Google Pay.
On the Google Play Store: payment is processed by Google under the terms of Google Play. Accepted methods depend on the User's country.
4.4 Renewal
The subscription renews automatically at the end of each period (monthly or annual), unless the User cancels before the renewal date. Payment is taken using the same method as for the initial subscription.
Article 5 — Right of withdrawal and waiver
5.1 Right of withdrawal
In accordance with article L221-18 of the French Consumer Code, the User has a period of 14 days from the date of subscription to exercise their right of withdrawal, without having to provide a reason.
5.2 Exception — digital content
In accordance with article L221-28, 13° of the French Consumer Code, the right of withdrawal does not apply to digital content supplied by electronic means when performance has begun with the express agreement of the User, and the User has expressly waived their right of withdrawal.
5.3 Express waiver
At the time of subscription, the User must tick an explicit checkbox agreeing that the service will begin immediately and waiving their right of withdrawal. This waiver is optional: the User may refuse and retain their 14-day right of withdrawal, in which case Premium access is activated after this period.
In accordance with article D221-5 of the French Consumer Code (in force since 19 June 2026), a User who wishes to cancel the contract may do so directly from their subscription management area within the Application.
5.4 During the free trial
During the free trial, no charge is made. Cancellation before the end of the trial incurs no fees. The 14-day right of withdrawal does not apply to the free trial, since no payment takes place.
Article 6 — Duration, cancellation, and refunds
6.1 Duration
The subscription is taken out for the duration of the chosen period (month or year) and renews automatically by tacit renewal at expiry, unless cancelled.
6.2 Cancellation by the User
The User may cancel their subscription at any time, with effect at the end of the current period. Premium access remains active until the already-paid expiry date. No early refund is due for the remaining period, except in the cases provided for in Article 6.4.
On the Web: cancellation is carried out from the Stripe Customer Portal, accessible from the account settings, or by email to contact@yinshi.app. In accordance with article L215-1-A of the French Consumer Code (Chatel Law) and article 21 of the DSA regulation (Digital Services Act), the cancellation procedure is as straightforward as the subscription procedure.
On the Google Play Store: cancellation is carried out from the User's Google Play account settings. The Publisher cannot cancel a Google Play subscription on behalf of the User.
6.3 Prior notice of renewal (Chatel Law)
For annual subscriptions, the Publisher sends a reminder by email no later than 15 days before the renewal date, indicating the price and the renewal date. Failing this, the User may cancel free of charge at any time after renewal (article L215-1-A of the French Consumer Code).
6.4 Refunds
6.4.1 Web subscriptions (Stripe) — Refund requests are examined on a case-by-case basis upon written request to contact@yinshi.app. An acknowledgement of receipt is sent within 48 hours. The decision is communicated by email. If approved, the refund is processed within 5 to 10 working days (bank processing times).
6.4.2 Google Play Store subscriptions — Refunds are processed by Google under the terms of the Google Play Store. The User must submit their request to Google. The Publisher does not have access to Google Play payment flows and cannot issue a refund on behalf of Google.
6.5 Major impossibility of use
In the event of a major impossibility of using the Service (all premium features entirely inaccessible for a consecutive period of more than 72 hours), affecting all users, and if the Publisher is unable to restore the Service within a reasonable timeframe, the User may request a pro-rata temporis refund of the unused subscription period.
6.6 Retention of refund data
Data relating to refund requests (identifier, reason, amount, status, communications) is retained for 5 years from the closure of the request, in accordance with accounting and tax obligations, and then deleted or anonymised in accordance with the Privacy Policy.
Article 7 — Guarantee and liability
7.1 Guarantee of conformity
The Publisher guarantees the conformity of the service with the description provided in Article 3. In accordance with articles L217-4 et seq. of the French Consumer Code, the User benefits from the legal guarantee of conformity and the guarantee against hidden defects.
7.2 Liability
The Publisher shall not be held liable for indirect damages resulting from the use of the service. The Publisher's liability is limited to the amounts paid by the User for the subscription over the preceding 12 months.
The Publisher is not liable for failures attributable to third parties (hosting provider, Supabase, Stripe, Google, Sentry, Google Analytics) or to cases of force majeure.
Article 8 — Intellectual property
All content within the Application is the exclusive property of the Publisher (see Legal Notice, Article 3). The Premium subscription grants a personal, non-exclusive, and non-transferable right of use. Any reproduction, redistribution, or commercialisation is prohibited.
Article 9 — Consumer mediation
In accordance with article L612-1 of the French Consumer Code, a User who is a consumer may have free recourse to a consumer mediator for the amicable resolution of a dispute concerning the performance of this contract. Mediation is a prerequisite to any legal action, except where another conciliation procedure is used.

The European Online Dispute Resolution platform (ODR) is accessible at ec.europa.eu/consumers/odr.
Article 10 — Personal data
The processing of personal data is described in the Privacy Policy.
Article 11 — Applicable law and jurisdiction
These Terms of Sale are governed by French law. In the event of a dispute, an amicable settlement will be sought first, notably through consumer mediation (Article 9). Failing that, the French courts shall have jurisdiction.
